VOWZI TERMS & CONDITIONS

Welcome to Vowzi (“Vowzi”, “we”, “our”, “us”).

These Terms & Conditions govern your access to and use of the Vowzi website, products, services, and equipment rental services. By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our services.

1. ABOUT VOWZI

Vowzi is an Australian-based camcorder rental and content experience business offering rental equipment, accessories, shipping services, and related products for personal and commercial use.

2. ELIGIBILITY

By using our services, you confirm that:
• You are at least 18 years old; or
• You have permission from a parent or legal guardian.

You must provide accurate and current information when placing an order.

3. RENTAL AGREEMENT

When you rent equipment from Vowzi, you enter into a temporary rental agreement for the specified rental period.

All equipment remains the property of Vowzi at all times.

You agree to:
• use equipment responsibly;
• follow any instructions provided;
• return equipment on time and in the same condition received (excluding fair wear and tear);
• not misuse, tamper with, modify, sublease, or sell equipment.

4. BOOKINGS & PAYMENTS

All prices are listed in Australian Dollars (AUD).

We reserve the right to:
• change pricing at any time;
• refuse or cancel bookings;
• limit rental quantities.

Full payment may be required before dispatch or collection.

Accepted payment methods will be displayed at checkout.

5. SECURITY DEPOSITS

Vowzi may require a refundable security deposit before dispatching equipment.

We may retain part or all of the deposit where:
• equipment is returned damaged;
• equipment is lost or stolen;
• accessories are missing;
• cleaning or repair costs are incurred;
• late fees apply.

Reasonable evidence of damage or loss may be provided upon request.

6. SHIPPING & DELIVERY

Estimated shipping and delivery timeframes are not guaranteed.

Vowzi is not responsible for delays caused by:
• Australia Post;
• couriers;
• weather events;
• public holidays;
• industrial action;
• circumstances beyond our reasonable control.

Risk in the equipment transfers to you upon confirmed delivery and remains with you until the equipment is returned and inspected by Vowzi.

You are responsible for ensuring shipping details are correct.

7. RETURNS

Equipment must be returned:
• by the agreed return date;
• using the provided return method (where applicable);
• with all included accessories and packaging.

Late returns may incur additional rental fees.

If equipment is not returned within a reasonable timeframe, Vowzi may treat the item as lost and charge replacement costs.

8. DAMAGE, LOSS & THEFT

You are responsible for the equipment during the rental period.

You agree to immediately notify Vowzi if equipment is:
• damaged;
• malfunctioning;
• lost;
• stolen.

You may be liable for reasonable repair or replacement costs where damage or loss occurs due to misuse, negligence, theft, unauthorised handling, or failure to take reasonable care.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under Australian Consumer Law.

9. AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees under the Competition and Consumer Act 2010 (Cth) or Australian Consumer Law.

Where required by law, Vowzi products and services come with guarantees that cannot be excluded.

You may be entitled to remedies including repair, replacement, refund, cancellation, or compensation where applicable under Australian Consumer Law.

10. WEBSITE USE

You agree not to:
• use the website unlawfully;
• attempt to interfere with website security;
• copy or reproduce content without permission;
• use automated systems or bots to access the website.

We may suspend or terminate access where misuse occurs.

11. INTELLECTUAL PROPERTY

All website content, branding, logos, graphics, videos, text, and designs are owned by or licensed to Vowzi.

You must not reproduce or use our intellectual property without written permission.

12. USER CONTENT

Where you submit reviews, social content, photos, or tagged content featuring Vowzi, you grant Vowzi a non-exclusive, royalty-free licence to repost, share, and display that content for marketing purposes unless you request otherwise.

You confirm you own or have permission to share submitted content.

13. PRIVACY

Your privacy is important to us.

We collect, use, and store personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth).

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Vowzi is not liable for:
• indirect or consequential loss;
• loss of profits;
• loss of content;
• event disruptions;
• delays outside our control;
• third-party courier issues.

Our liability is limited, where permitted by law, to:
• resupplying the service; or
• the cost of resupplying the service.

Nothing in these Terms excludes liability that cannot legally be excluded.

15. FORCE MAJEURE

Vowzi is not liable for failure or delay caused by events outside reasonable control, including:
• natural disasters;
• severe weather;
• internet outages;
• pandemics;
• government restrictions;
• transport disruptions.

16. TERMINATION

We reserve the right to refuse service, suspend accounts, or cancel orders where:
• fraud is suspected;
• these Terms are breached;
• unlawful activity occurs.

17. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

Any disputes will be subject to the non-exclusive jurisdiction of the courts of New South Wales.

18. CHANGES TO THESE TERMS

We may update these Terms at any time.

Updated Terms become effective once published on our website.

Continued use of Vowzi services constitutes acceptance of the updated Terms.
